Liens for Auto Repair Shops and Towing Companies

A lien on the sale of a vehicle or vessel can be enforced by the following:

• A repair shop claiming a lien for performing labor or services on a motor vehicle;
• A towing company claiming a lien for reasonable towing and storage fees.

By law, a notice of lien and notice of sale must be given to the owners, lienholders, and insurance companies for the vehicle or vessel.

The Florida Department of Highway Safety and Motor Vehicles (FLHSMV) requires that repair shops and tow companies use approved third-party service vendors to send notice of lien and notice of sale documents to owners, insurance companies and lienholders, in accordance with 713.78 and 713.785, Florida Statutes.
